Understanding Abuse & Neglect Charges in MI
Child abuse is a crime that police, law enforcement officials, and prosecutors alike take very seriously. Anyone found guilty may be penalized under the full extent of the law.
Though child abuse charges are handled through the criminal justice system, a separate investigation designed to ensure the safety of children with those who care for them may also occur. Since 1975, Child Protective Services (CPS) – a program within the Department of Human Services (DHS) – has been responsible for investigating such allegations. The Michigan Child Protection Law (MCL 722.621-638) provides a framework for what CPS must do.
Michigan Child Protection Laws
Under Michigan’s child protection laws:
- Child abuse is defined as any harm or threat of harm that affects a child’s health or well-being. The abuse can be physical, psychology/mental, or sexual in nature.
- Child neglect is defined as any harm or threat of harm committed by a person responsible for the child’s well-being through negligent treatment. Examples of neglect include failing to provide adequate food, shelter, medical treatment, or clothing for the child. Neglect can also occur if the adult in charge of caring for the child fails to intervene or eliminate a risk to the child’s well-being that they are aware of.
